Terms and Conditions

General Provisions:

Initial Payment if the arrival date is greater than 90 days from time of booking: 50% of the total amount of the booking shall be paid in order to secure the booking. If the arrival date is less than 90 days from the booking date 100% is due to secure the booking.

Final Payment: Total remaining balance is due 90 days prior to arrival date. If this payment is not made, the reservation will automatically be cancelled and be subject to cancellation charges.

Forms of Payments: Payments may be made by personal check, cashier’s check, money order, E-check, or credit card in U.S. funds. When payment is made by personal check, money order, or cashier’s check if the payment is returned for any reason including but not limited to insufficient funds, you shall be responsible for a flat fee of $100.00 in addition to any and all returned payment fees charged by our bank. Postdated checks will not be accepted. Online payments are recommended, and you can use the following link below. All you need to login is the email address we have on file and your arrival date.

Security Deposits: Some properties require a security deposit of $500 or more which is paid upon booking. Such security deposit shall be used to cover any damage to the rental unit during the rental period which is in excess of ordinary wear and tear. See the paragraph titled “Damage to the Rental Property” below for additional terms and conditions.

Cleaning Fees: Cleaning fees apply to all reservations and vary based upon the size of the rental unit and duration of the stay. The fee ranges from $200.00 to $800.00. Excess cleaning will incur an additional charge deducted from your security deposit if applicable or if the home does not require a security deposit it will be charged to your credit card on file.

Accidental Damage Insurance Fee: Beach House Real Estate charges guests a fee of $99 for the purpose of insuring accidental damage to the property during the stay. This is to insure major items that are accidentally damaged. This is an insurance fee and is not refundable.

Administrative Fee: An administrative fee of $199 is charged for every reservation. This fee covers all administrative work and is not refundable.

Taxes: Taxes apply to all reservations less than six (6) months long. The rate currently is 12% (7% Florida State Sales Tax and 5% Manatee County Resort Tax).

Proof of Identification: A copy of a valid driver’s license or passport is required to verify identity.

CANCELLATIONS: A cancellation fee of 10% of the total booking amount will be deducted for any cancellation prior to 90 days from arrival date. Any cancellation within 90 days from arrival date will be non-refundable. Beach House Real Estate will not issue refunds or discounts due to inclement weather, hurricane, tropical storms, red tide, or any other act of nature.

CHANGES TO RESERVATIONS: A reservation change fee of $300.00 shall apply to all reservations that are changed in any manner, including shortening of stay or change of rental dates.

CHECK-IN, CHECK-OUT: It is important for you to print out your confirmation and bring it with you when you check in. Check-in is at 4:00 P.M. Check-out is at 10:00 A.M. While Beach House Real Estate, LLC will make every effort to accommodate early arrivals and late checkouts, Beach House Real Estate, LLC does need time to clean the rental properties between guests. Early check-in and late check-out fees may apply. Please follow check-in and check-out instructions, including making sure all windows and doors are locked upon departure. Please do not contact us for an early check in, if your property is available for one – we will reach out to you the day of your arrival. Please do not park any vehicles at the properties or leave any luggage at the properties prior to check in time.

Electronic Locks: If the property has electronic locks instructions will be emailed to you prior to check-in.

KEYS: Keys will be located in a lock box located at the rental property. Beach House Real Estate, LLC will provide you with instructions for use of such lock box. Keys shall be obtained from the lock box upon check-in and shall be placed in the lock box at the time of check-out. Please take care of the keys. Lost key fees apply, and a lock-out fee will apply for after-hours emergency calls. Please do not leave keys in the unit or give them to anyone other than Beach House Real Estate, LLC personnel.

OCCUPANCY: Each unit has a maximum rental occupancy of which you are informed when booking your rental. Overcrowding will result in immediate eviction without refund.

GUEST REQUIREMENTS: The Guest making the reservation must be present during the stay; sub-letting is not permitted. Guests must always abide by the maximum number of persons allowed, which varies by property, as published on our site. Public Events are not permitted without prior, written approval from Beach House Real Estate. The Guest is criminally and civilly/financially responsible for all conduct of all persons on the property, including but not limited to any type of issued violation such as traffic and parking tickets, noise complaints, and turtle ordinance violations.

MINIMUM AGE: Guests must be a minimum age of 25 years old on the day of arrival unless specifically approved in advance in writing. You agree to provide us with proof of age upon request. All persons staying at the property under the minimum age must be accompanied by their parent or legal guardian for the entire duration of the rental, provided that Guest may provide to Beach House Real Estate the express written consent from the parent or legal guardian for any person under 25 years old who is going to stay at the property who is not a child or ward of Guest. We reserve the right to reject or terminate reservations made under false pretenses. Violations of this policy will result in the loss of all payments and immediate removal from the property without a refund.

SMOKING: All rental units are NON-SMOKING! If smoking outdoors, all smoking debris must be disposed of in appropriate trash receptacles. Any signs of smoking indoors or improper disposal of smoking debris will forfeit security deposit and may incur additional charges and/or result in immediate eviction without refund.

HOUSEKEEPING: Properties are cleaned and fresh towels and linens are provided at the start of each stay. We do not provide daily housekeeping or daily linen/towel service. Mid-stay cleans can be arranged for a fee. Contact Reservations for more information.

PETS: Some rental units may be pet friendly. Please contact Beach House Real Estate, LLC for additional information on pet-friendly properties. All pet-friendly properties require an additional pet fee of $250.00. The pet fee is non-refundable and is applied to the additional cleaning costs. Any pets on the properties without prior permission will result in immediate eviction without refund.

TRASH AND RECYCLABLES DEPOSIT: Tenants agree to take out the trash and recyclables combined on the property at the end of this Lease. Tenants who violate this policy will be assessed an additional cleaning fee of $50.00.

Specific to your Unit:

General Provisions Applying to All Amenities: Amenities vary by property. Please ask if an amenity you are looking for is not listed on our website. Some amenities will change periodically. Beach House Real Estate, LLC cannot be held liable for changes made to properties or mistakes on the website. Discounts and refunds are not available due to inoperable equipment; however, Beach House Real Estate, LLC will do its best to repair any issues immediately. You and your guests accept and assume all risks involved in and around all amenities provided. You also expressly waive and relinquish any rights or claims against the owner of the rental property and Beach House Real Estate, LLC for any damage that may result to you or your guests from lack of maintenance, cleanliness, repair, or defect of amenities.

Basic Amenities: All of our properties include basic amenities: air conditioning, cable television, internet, linens (bed and bath) and fully stocked kitchens. You will need to purchase paper and cleaning products (napkins, paper towels, hand soap, toilet paper, dishwasher detergent, laundry detergent and garbage bags) as needed. Beach towels, beach chairs and BBQ grills may be provided in some rental units. Please check with Beach House Real Estate, LLC as to the items provided in any specific rental property.

Swimming Pools: Some properties include heated swimming pools. All of our heated swimming pools are set to approximately 80 degrees and heating charges are included in the rental fee, unless otherwise noted. Beach House Real Estate, LLC will make every effort to ensure that your swimming pool stays in the set range; however, Beach House Real Estate, LLC cannot be held responsible for extreme weather or inoperable equipment preventing or inhibiting use and no refunds will be offered if such occurs. Beach House Real Estate, LLC also cannot guarantee that the swimming pool will be able to maintain that temperature during colder weather. Following inclement weather or high winds, pool services cannot be expected “on demand” for removal of fallen leaves or minor debris. While swimming pools are regularly cleaned, treated, and maintained at the owner’s expense, when renting a property with a swimming pool, it is important to remember that your help in maintaining it, to some degree, is expected.

POOL EQUIPMENT: Licensed and insured Pool Technicians maintain all pools and pool equipment. All guest-accessible features can be controlled using the pool remote that is usually located in the immediate pool patio area. Any other changes to the pool equipment, settings, controls, and valves are strictly prohibited as they may result in severe damage to the pool and/or spa. The guest shall be responsible for any service call and associated repairs. Most pool equipment areas are fenced and may be electronically monitored.

Internet Service: Many rental units offer various forms of high-speed internet services for your convenience; however, Beach House Real Estate, LLC cannot guarantee that you will be able to connect. Beach House Real Estate LLC will do its best to assist you but cannot be held responsible and no refunds will be offered if you are unable to take advantage of this service.

ITEMS LEFT IN UNIT: Neither the owners of the rental units nor Beach House Real Estate, LLC will be responsible for any personal items left in the rental units. If you request Beach House Real Estate, LLC to retrieve and mail items left in the rental unit, you will be responsible for actual mailing/shipping charges in addition to a $25.00 handling fee.

DAMAGE TO THE RENTAL PROPERTY: You shall be responsible for any damage to the rental unit during your stay which is in excess of ordinary wear and tear, missing items and loss of keys and remote controls. It is your responsibility to notify Beach House Real Estate, LLC immediately upon arrival if you notice anything broken, missing, soiled or that otherwise could be charged against your security deposit. Upon inspection of the property following check-out, Beach House Real Estate, LLC will notify you in writing of any such damage to the property, and the charges thereof, within fourteen (14) days of check-out. The charges may be deducted from the amount of the security deposit if applicable or charged to a credit card. At that time, if the amount of the security deposit is insufficient to cover the damage and/or missing or lost items, you are responsible for the additional charges for the damage and/or missing or lost items, which charges must be paid within fourteen (14) days of notification of the damage and/or missing or lost items. If no excess damage is and/or missing or lost items are incurred, the security deposit will be returned to you within thirty (30) days of check-out. You acknowledge that Beach House Real Estate, LLC reserves the right to use any and all payment information it has on hand and to charge for any damage and/or missing or lost items discovered at the rental property.

TRAVEL INSURANCE: You are responsible for obtaining any travel insurance to cover unforeseen illness, accident, jury duty or adverse weather that prohibits travel and/or stay at the rental unit as neither the owner of the rental property nor Beach House Real Estate, LLC will issue refunds for these and the other reasons as set forth throughout this Agreement. To protect against the loss of your rental payment and deposit, travel insurance is strongly recommended. Travel insurance is provided to U.S. citizens through the CSA Travel Protection Plan. For details as to what is covered, please consult Generali Global Assistance at 866-999-4018 plan CSA320 (www.vacationrentalinsurance.com).

FINES FOR COMPLAINTS AND OTHER VIOLATIONS: If the owner of the rental property receives a fine for any complaint, including but not necessarily limited to noise complaints, or any other violation of local, state or federal ordinance, rule, statute or other law or policy, which fine is issued for conduct which took place at or about the rental property during the stay of tenant, tenant shall be responsible for reimbursement for such fine, which fine may be deducted from any and all deposits placed by tenant. In the absence of deposits, charges will be made to the credit card on file or payment can be made directly by the guest.

HOUSE PARTIES, REUNIONS AND LARGE GATHERINGS: House parties, family reunions, weddings, anniversaries and other large gatherings are prohibited unless arrangements have been made with Beach House Real Estate, LLC in advance of the rental period. Please note the maximum occupancy on the property. Overcrowding will result in immediate eviction without refund.

HOMES FOR SALE: Some of our rental properties are for sale and may require showings with a twenty-four (24) hour notice. Beach House Real Estate, LLC will make every effort to limit interruptions during your stay.

AGENCY: Beach House Real Estate, LLC is the authorized agent for the owner of the rental property. Beach House Real Estate, LLC reserves the right to make reservation changes due to unforeseen circumstances or for any reason, which changes may include your relocation to an alternate rental property of similar quality.

DISPUTES: Any action brought pursuant to the terms of this Agreement shall be brought in Manatee County, Florida. The prevailing party in any such action shall be entitled to reimbursement for all attorney fees, including attorney fees on appeal, costs and interest incurred in connection therewith.

INDEMNITY: You shall indemnify and hold harmless the owner of the rental property and Beach House Real Estate, LLC from any claims and demands arising from:

Your use or anyone you allow to use or possess the property, and anything done or permitted by you in or about the rental property

HAZARDS: It is unknown if there are hazards that affect the premises. Hazardous substances in the home include cleaning chemicals, paint, lawn and garden chemicals, and a variety of indoor air pollutants. Hazardous substances outside the home include those found in contaminated land, water, landfills, and industrial air and water emissions. Some of the more common hazards are asbestos, groundwater contamination, lead based paint, urea formaldehyde, foam insulation (UFFI), mold, mildew, and Radon gas. Any property built prior to 1978 may contain a lead based paint hazard.

RADON GAS DISCLOSURE: Pursuant to Section 404.056(5), Florida Statutes, radon is a naturally occurring radioactive gas that when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time. Levels of radon that exceed Federal and State guidelines may have been found in buildings in Florida. Additional information regarding radon and radon testing may be obtained from your County Public Health Unit.

TAX LAW CHANGES: In the event of any tax law changes, the guest is responsible to pay the monetary difference that might occur. These changes can affect reservations already paid in full and the guest is responsible to pay the additional fees shall it occur.

NOISE ORDINANCE: The Island does have a noise ordinance that goes into effect after 10 pm, this ordinance pertains to any loud music or loud sounds coming from the property after this hour. If the police or the Management Company is called due to the renters disturbing the peace, we do reserve the right to terminate the rental agreement immediately without refund.

CONSTRUCTION: In the event of neighboring construction, Beach House Real Estate shall not be held responsible to provide any type of advance notification to incoming guests, as we do not receive any type of notification of new or ongoing construction projects (new construction, exterior or interior renovations, pool/landscaping installation, etc…). Property views are subject to change due to construction that may occur on the island.

PARKING: Guests must follow the parking rules of each home, the homeowner’s association rules if applicable, and City or County ordinances. The number of parking spaces is advertised in the home’s listing. Securing any additional parking is the guest’s responsibility. Parking of commercial vehicles, recreational vehicles, boats or marine vessels or equipment, trailers of any kind, or otherwise is prohibited without approval by Beach House Real Estate, in writing, before your arrival date.

EVENTS: Beach House Real Estate manages several properties which are able to host events such as weddings, rehearsal dinners, anniversary dinners, receptions, etc. This includes a select group of properties only. Please keep in mind that these are privately owned homes and not all owners allow events to be held at the property and not all properties are able to accommodate certain festivities. If you are interested in hosting a function during your vacation, please give us a call directly at 941-216-3793 to discuss the possible properties, requirements as well as the rules and regulations involved. Failure to notify us of an event is subject to a 25% surcharge of the total cost of the reservation and/or termination of the rental agreement.

KEYS: Renters who lose their keys or lock themselves out after office hours must call 941.216.3793. If required, the renter is responsible for paying any locksmith call out charge and the replacement key charge. If the keys are not left in the property upon departure, there will be a $25 key replacement charge.

RATE CHANGES: Rates are subject to change without notice on the website. Confirmed booking rates will never be changed unless directed by the customer ie: additional days added.

ONLINE BOOKING AND INFORMATION: The information provided, though deemed accurate, is not guaranteed. It is subject to errors, omissions, change of price or withdrawal without notice.

INDEMNIFICATION: Beach House Real Estate shall not be liable to guests or to any party for any damages to property or for the injury to persons on the premises from any cause whatsoever, including defects in the premises or otherwise: guests shall indemnify and hold harmless Beach House Real Estate from any and against all liabilities, claims, expenses, fees, loss of use of actions of any and any kind arising out of renters or their guests use and occupancy of the premises. The management is not responsible for accidents, injury, or loss of personal belongings of any kind.

VIOLATIONS: Beach House Real Estate shall not be liable to guests or to any party for any type of issued violations, including but not limited to: traffic tickets, noise complaints, turtle ordinance violations, etc. The sole responsibility lies on the responsible party including any incurred fees.

LIABILITY FOR PROPERTY OF GUESTS: Beach House Real Estate is responsible for providing safe and sanitary lodging, under the provisions of Chapter 509, Florida Statutes. Beach House Real Estate is under no obligation to accept for safekeeping and hereby, expressly disclaims acceptance of any money, securities, jewelry, precious stones of any kind, wearing apparel, or other property of the guest, and by law, has limited liability for the loss thereof. Supervision or safekeeping of guest’s vehicle(s) is not subject matter of these Terms and Conditions. Beach House Real Estate accepts no duty of safekeeping whatsoever. Therefore, Beach House Real Estate is not liable for theft/ misappropriation etc. of the vehicle, of vehicle parts and components or of vehicle contents. Beach House Real Estate is not liable or responsible to any guest for the loss of wearing apparel, goods, or other property.

Check Out Procedures

Check out is before 10am. If you happen to be leaving early, can you please let me know, this way Beach House can start the cleaning crew sooner.

We recommend upon departure:

1. Put all dirty dishes in the dishwasher and start dishwasher prior to leaving

2. Return any furniture inside or out that may have been moved to its original position

3. Do not wash the linens at the property

4. Please lock all doors and return keys to the lock box or where you originally received them

5. Please burn off and scrape all grills clean

6. Notify us of any damage made to the property
